These terms of use (Terms & Conditions) are a legal agreement between you and The Voucher Discount Cards Services (hereafter referred to as “The Voucher App”, “App”, “we”, “our” or “us” as the context may require) a sole establishment incorporated in UAE, and registered under license 956091 issued by the Department of Economic Development in Dubai, for the use of The Voucher App mobile application and any website operated and owned by The Voucher Discount Cards Services including without limitation www.TheVoucherApp.com. The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, these “Terms of Use"), govern your access to and use of our website, including any content, functionality and services offered on or through our website, and our online application that runs on smart phones, tablets and other devices which provide dedicated non-browser-based interaction between you and our website (all of which are collectively called our “Website"), whether as a guest or a registered user.
By downloading, installing, or using The Voucher App, or accessing the website (www.TheVoucherApp.com) you agree to these terms & conditions and will automatically apply to you – you should make sure therefore that you read them carefully before using the app. If you don’t agree with these terms and conditions, don’t download, install, or use TheVoucherApp or its website (www.TheVoucherApp.com).
The Voucher App permits you to use the App and website solely in accordance with these Terms of Use. The Voucher Discount Cards Services always retains ownership of The Voucher App and its website (www.TheVoucherApp.com) at all times.
These Terms of Use apply to the use of any updates or changes to The Voucher App and its website that we may issue from time to time.
The Voucher Discount Cards Services grants you non-exclusive, non-transferable, recoverable license to do the following in accordance with the Terms of Use (the “Licenses”):
Download, install and use The Voucher App, and any updates to it provided by The Voucher Discount Cards Services from time to time, in object code form for your personal use only on a compatible mobile device owned or controlled by you; and
Access and browse The Voucher Discount Cards Services website for your personal use only.
The Voucher Discount Cards Services may terminate the Licenses granted under these Terms of Use at any time in its absolute discretion with or without notice to you. If you breach any provisions of these Terms of Use such Licenses shall automatically terminate. Where any of the Licenses are terminated, you agree to immediately cease using and accessing The Voucher App and its website and to delete any copies of The Voucher App held by you.
Rights of Use
Access and use of The Voucher App that requires the registration or the creation of a User account with The Voucher App along with a password. All registration information you submit must be accurate and updated.
We reserve the right to immediately terminate or restrict your account or your use of The Voucher App at any time, without notice or liability, if The Voucher App determines in its sole discretion that you have breached these Terms, violated any law, rule, or regulation, or engaged in other inappropriate conduct.
You are responsible for taking all reasonable steps to ensure that no unauthorized person shall have access to your App password or account. It is your sole responsibility to (1) control the dissemination and use of sign-in name, screen name and passwords; (2) authorize, monitor, and control access to and use of your App account and password; (3) log out every time you use the App and/or Website and promptly inform The Voucher App if you believe your account or password has been compromised or if there is any other reason you need to deactivate a password. You grant The Voucher App and all other persons or entities involved in its management the right to transmit, monitor, retrieve, store, and use your information in connection with the operation of the Site and/or App. The Voucher App cannot and does not assume any responsibility or liability for any information you submit, or your or third parties' use or misuse of information transmitted or received using The Voucher App tools and services.
You are responsible for maintaining the confidentiality of your account.
You may be notified that it is necessary to download software or other materials or agree to additional terms and conditions. Unless otherwise provided by these additional terms and conditions, they are hereby incorporated into these Terms.
Access to The Voucher App is permitted on a temporary basis, and we reserve the right to withdraw discontinue or amend the services we provide without notice. We will not be liable if for any reason The Voucher App is unavailable at any time or for any period.
You are responsible for using compatible equipment and for any internet, communication or other costs you may incur to access The Voucher App.
By using our App you are agreeing to be bound by the Terms of Use of Google or Apple Maps API.
We shall not be liable to you for any loss of connection to the internet from your mobile device or malfunction or failure of your mobile device, which prevents you accessing the App.
By using The Voucher App, you confirm that You are of legal age i.e. over 18 years. If You have agreed to allow Your minor child, or a child for whom You are legal guardian ("Minor"), to use The Voucher App, You agree that You shall be solely responsible for: (a) the online conduct of such Minor; (b) monitoring such Minor’s access to and use of the Site; and (c) the consequences of any use of the Site by such Minor.
Intellectual Property Rights
You acknowledge that all Intellectual Property relating to The Voucher App belongs to us or our licensors or Content providers, that rights in the Intellectual Property are licensed for use not ownership to you, and that you have no rights in, or to, the Intellectual Property other than the right to use the Intellectual Property in accordance with these Terms.
You are not allowed to print, copy, or modify the App/website, content, photos, videos, information, or use our logo and trademark in any way. You’re not allowed to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. You have no right, and shall not permit any third party to copy, adapt, reverse engineer, decompile, disassemble, modify or reproduce the App or the Services in any way without obtaining our express prior written consent in each instance or to the extent required by law.
The App, website, logos, data, trademarks, copyright, database rights and other intellectual property rights related to it, still belong to The Voucher Discount Cards Services.
You may use our logo, content and Trademarks, as part of the App use, acknowledging that this use is under license from us, and that your use will not cause any confusion as to their ownership.
Except as expressly stated herein, these Terms do not grant you any rights to, or in,
patents, copyrights, database rights, trade names, trademarks (whether registered or unregistered), or any other rights or licenses in respect of the Intellectual Property, our Site, the App and the material published on it.
If you print, copy, modify, download or otherwise use or provide any other person with access to any part of the Website or App in breach of the Terms of Use, your right to use the App & Website will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
Trademarks
The Company name and trademarks, the Company logo and all related names, logos, product and service names, designs and slogans are trademarks of the Company. You must not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs and slogans on the Website are the trademarks of their respective owners.
Limitation on Liability
THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. YOU SPECIFICALLY ACKNOWLEDGE THAT THE VOUCHER APP IS NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD-PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH YOU.
IN NO EVENT SHALL THE VOUCHER APP, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, MANAGERS, OR ANY PERSON OR ENTITY INVOLVED IN PROVIDING THE SERVICE, BE LIABLE FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICE (APP & WEBSITE). YOU HEREBY ACKNOWLEDGE THAT THE PROVISIONS OF THIS SECTION SHALL, WITHOUT LIMITATION, APPLY TO ALL CONTENT ON THE VOUCHER APP (APP & WEBSITE).
IN ADDITION TO THE TERMS SET FORTH ABOVE, NEITHER THE VOUCHER APP, NOR ITS AFFILIATES, INFORMATION PROVIDERS OR CONTENT PARTNERS SHALL BE LIABLE REGARDLESS OF THE CAUSE OR DURATION, FOR ANY ERRORS, INACCURACIES, OMISSIONS, OR OTHER DEFECTS IN, OR UNTIMELINESS OR UNAUTHENTICITY OF, THE INFORMATION PROVIDED IN CONNECTION WITH THE SERVICE, OR FOR ANY DELAY OR INTERRUPTION IN THE TRANSMISSION THEREOF TO YOU, OR FOR ANY CLAIMS OR LOSSES ARISING THEREFROM OR OCCASIONED THEREBY. NONE OF THE FOREGOING PARTIES SHALL BE LIABLE FOR ANY THIRD-PARTY CLAIMS OR LOSSES OF ANY NATURE, INCLUDING WITHOUT LIMITATION LOST PROFITS, PUNITIVE OR CONSEQUENTIAL DAMAGES.
THE VOUCHER APP IS NOT RESPONSIBLE FOR ANY CONTENT THAT YOU, ANOTHER USER, SUBSCRIBER, OR AN UNAUTHORIZED USER MAY POST ON THE VOUCHER APP WEBSITE. ANY CONTENT THAT IS POSTED OR UPLOADED THAT IS OR MAY BE DEEMED UNSUITABLE CAN AND MAY BE TAKEN DOWN BY THE VOUCHER APP. FURTHERMORE, THE VOUCHER APP RESERVES THE RIGHT TO EDIT, CHANGE, ALTER, DELETE AND PROHIBIT ANY AND ALL CONTENT THAT IT DEEMS UNSUITABLE IN ITS SOLE DISCRETION.
THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
User Age Restrictions
The Voucher App and its website are not intended to be used by children under 18 years old. If you are under the age of 18, you must not use the App and its website. If we discover that any such use is taking place we will immediately terminate any relevant user account(s) facilitating such use. If you are below age of 18, you must have obtained the consent of your parent or legal guardian to your use of The Voucher App and its website (www.TheVoucherApp.com).
Links and Communication with Third Parties
Where our Site or App contains links to other sites, apps, products, services and Resources provided by third parties, these links are provided for your information only and without any liability or warranty on our part. We have no control over the contents of those sites or resources or services or products, or how they handle any links we provide to them, and we accept no responsibility for them, their legality or for any loss or damage that may arise from your use of them.
Where our App or Site may contain a feature allowing to communicate a report, claim, comments, the communication will be made via email through the internet network which may be insecure. The Voucher App will endeavor to secure the communication however cannot give any warranty for and cannot be held responsible for any loss or damage that may arise from the same.
Geographic Restrictions
If you download, use or access the App and website outside UAE then it’s your own responsibility to comply with that abroad relevant laws of the country and we have no responsibility of any actions happened.
Disclaimer of Warranties
We are not liable for the misuse of data, or your device, or any file downloads from the internet that might be infected by viruses or other malicious actions. It’s on your own responsibility for taking precaution and protection measures to make sure your accessing safe data. We will not be liable for any loss or damage caused by a virus, attack, malicious works, cyber-attacks, worms, Trojans, or any harmful technology that may infect your hardware device or software or data due to your use of website or internet. Your use of the App, Website and internet is at your own risk, without any warranty from our side. The company hereby disclaims all warranties of any kind, whether express or implied, statutory or otherwise, including but not limited to any warranties of merchantability, non-infringement and fitness for particular purpose.
Disclaimer & Limits
The Voucher App may contain technical inaccuracies or typographical errors. Information may be changed or updated without notice. The Voucher App may also make improvements and/or changes in the products and/or services described in this information at any time without notice.
The Voucher App is designed just to help You find the best offers, but you have to contact the merchant first before using any offer or service, to make sure the service or product is available. We are not liable for any discrepancy happens.
You may not use The Voucher App for any illegal or unauthorized purpose nor may you, in the use of The Voucher App, violate any laws in your jurisdiction.
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by Force Majeure. Force Majeure means any act or event beyond our reasonable control, including without limitation accident to or breakdown of delivery vehicle, strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, pandemic, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
Rules of Use
The use of all Voucher Offers (“Offers”) by our members are subject to these Rules of Use (“Rules”) and any terms of use included on the Offers. Users should read these Rules carefully prior to using any Offer:
Offers can be used 24/7 subject to the merchant’s working hours and exclusions of public holidays.
Offers can’t be used with any conjunction with any other offer or promotion.
Each voucher (2-for-1) can be redeemed for 2 persons, and it’s up to the merchant to accept more vouchers at the same time.
You have the option to use (2-for-1) or %Discount vouchers while redeeming your voucher and see which best saves you money.
Voucher should be presented first before paying your bill.
Voucher is specified for certain menu items and might not include all items, so member has to check with the merchant about the included items in the Voucher offer.
Some Vouchers can be reused multiple times subject to the merchant acceptance, while other merchants limit to specific number of allowed offers and they will be locked (for example 3 vouchers maximum are allowed with the merchant).
Members have the chance to unlock the Voucher by using Reward points accumulated in their account from previous purchases.
The member is not allowed to share his account with friends to use the Vouchers.
Redeeming an Offer on the App:
Browse the App and select the offer you want, and inform the merchant employee first that you want to use The Voucher App before ordering.
Present your mobile device with the chosen Voucher to the employee before paying your bill.
The merchant is prompted to enter their PIN and the discounted amount.
Once the merchant has entered their PIN, the Voucher will be redeemed and you will enjoy the saving.
Once the Voucher is redeemed then it will not be refunded or canceled.
In the case of a dispute, the bill must be settled as per UAE law. Relevant parties will be contacted for resolution.
Offers redeemed are not inclusive of any applicable service charges/taxes and will be separately charged by merchants in compliance with UAE tax regulations/laws.

Offers are valid from Jan 1 to Dec 31 of every year, unless otherwise specified. We reserve the right to remove and/or amend an Offer at any time and cannot be held responsible or liable in any way if an Offer is removed or amended from the App.
The Voucher Tourist package is valid for 30 days from the date of purchase. We reserve the right to remove and/or amend an Offer at any time and cannot be held responsible or liable in any way if an Offer is removed or amended from the App.
Vouchers are not redeemable for cash. Illegal reproduction, resale or modification of any Offer is prohibited. Offers are void if resold.
There will be specified number of vouchers per branch and not per merchant (could be 3 Vouchers per branch), subject to Merchant terms & conditions. Redeeming a voucher in one branch will not affect the allowed vouchers available for the other branch (of same Merchant), and this is subject to the Merchant’s terms and conditions. While other Merchants limit it and any used voucher from any branch will lock the voucher per merchant and not per branch.
We are not liable for any change in price at the merchant side (onsite) which doesn’t match their price on our App. We will make sure to update the merchant price and menu on our App on timely manner. So please check merchant price before ordering.
The least item price should be discounted as per the merchant policy. And the 2 items should be of the same kind shown in the Voucher, like for example Buy Pizza get free Pizza.
Check the terms of each Voucher before ordering as some Offers are not valid for delivery or take-away, unless otherwise indicated on the Offer or included in the Online Delivery option. Or some offers are restricted in public holidays or other events.
Information that you should know for the Online Delivery option:
You can apply more than one voucher (2-for-1) at the same time in the same order. While (%25 Voucher on total bill) can be used once.
For Online Delivery, the Delivery charges will apply to the bill after the discount has been calculated and applied. The discount will not be applied on the delivery charge. The Delivery fees will be set by Merchant on the App and added as extra fees on the bill separately.
The Expected Delivery time is set by the Merchant on the App, and it's the sole responsibility of the Merchant to deliver in the allocated time frame. The Voucher App takes no responsibility and is not liable in any way whatsoever in this regard.
Our Online Delivery service includes a system calculator that informs the user which best Voucher to apply and give you optimum savings (2-for-1 or % discount).
If Members choose to redeem from the 2-for-1 Offers, they must select at least 2 valid item offers from the merchant menu.
For Online Delivery, complaints regarding food quality, delivery times, or inaccurate orders should be directed to the merchants/outlets. The VoucherApp takes no responsibility and is not liable in any way whatsoever in this regard.
The Voucher App is unable to track orders with the outlet. It is the responsibility of the merchant/outlet to deliver within the promised timings. For any queries about the location of delivery drivers, Members are to contact the merchant/outlet directly.
The Voucher App is not liable if a merchant/outlet cannot fulfil an order for whatever reason. If a Member has been charged an amount by the Voucher App for an order which was not fulfilled please contact us on Admin@TheVoucherApp.com.
The time, location and delivery are subject to the availability of the Merchant and should be within the working time hours of the Merchant, and within the accepted distance covered by the Merchant’s delivery service. So, order might be rejected to be placed if it doesn’t meet the above terms (time and distance).
Once the Voucher is redeemed or Order is placed then it will not be refunded or canceled.
User will receive confirmation email within 5 minutes (Depending on user internet connection) for the placed Order and payment showing the details of the order (Order number, items ordered with price breakdown, and Merchant contact details).
The Voucher App will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of United Arab Emirates.
All order amendments or cancellations are based on the terms and conditions of the merchant, and not The Voucher App.
Prior booking may be required for certain offers and/or activities.
Check Merchant terms and conditions before using your voucher, as some merchants (like attractions offers) have restrictions on capacity, number of persons, age, height, weight, health conditions and fitness, prior booking, weather conditions, etc.…
The holder and issuer of a Merchant Voucher is the Merchant. As a holder and issuer of the Voucher, the Restaurant or Merchant is fully responsible for any and all injuries, illnesses, damages, claims, liabilities and costs suffered by or in respect you, whether caused in whole or in part by the Restaurant or the Merchant, as well as for any unclaimed property liability arising from unredeemed Vouchers. Merchant Vouchers are redeemable in their entirety only and may not be redeemed incrementally.
The issuing of credit is at the sole discretion of the Merchant unless otherwise required by law.
Vouchers are non-refundable and non-transferrable.
Neither The Voucher App nor the Merchant is responsible for lost or stolen Vouchers or a Voucher's reference number.
Reproduction, sale or trade of a Voucher is prohibited unless done so in compliance with the law.
Any attempted redemption not consistent with these terms and conditions will render the Voucher null and void.
If you redeem the Voucher for less than its face value, you will not be entitled to a credit, cash or a new Voucher equal to the difference between the face value and the amount you redeemed, unless otherwise required by law. You will only be entitled to a continuing redemption value as noted above if the amount that you paid for the Voucher exceeds the amount you redeemed. For example, if you paid AED 70 for a Voucher which entitles you to purchase AED 100 of product by Feb, 2021 and you make a purchase for AED 80 on Jan 31, 2021, you will not be entitled to a credit or cash equal to the difference between the AED 100 face value and the amount you redeemed. You will not have any redemption value either because the amount you redeemed is more than what you paid for the Voucher.
According to the laws of the respective states in which you purchased your Voucher, and in which you wish to redeem your Voucher with the Merchant, the Merchant is responsible for allowing you to redeem your Voucher for the cash value based on the money you actually paid for your Voucher (i.e. if you paid AED 30 for a Voucher which gives you AED 50 of value to the Merchant, the cash value that you paid is AED 30, not AED 50), for a period of time that may extend beyond the expiration date on the Voucher. While the expiration date on the Voucher dictates the last date that you can use your Voucher at Merchant for the promotional offer which is stated on the Voucher, state laws (which vary state-by-state, and which are generally made available by each State on the web) may provide that the Merchant is responsible for honoring the cash value that you paid for your Voucher for a period of time beyond the expiration date stated on the Voucher. If applicable, this is a statutory provision which applies to the Merchant, and it is the sole responsibility of the Merchant (and in no way the responsibility of The Voucher App, as The Voucher App is not the Merchant, has no obligations of the Merchant, and is merely selling the promotional Voucher on behalf of the Merchant) to comply with such applicable laws and statutes which may govern the Merchant.
Redemption frequency is determined by Merchants, and shall be contained in the Voucher offer.
It is at the discretion of the Merchant to determine whether Vouchers can be combined with any other Merchant offers, third party offers, vouchers, or promotions.
Merchant Vouchers cannot be used for taxes, tips or prior balances, unless permitted by the Merchant.
Valid for dine in or at merchant store only unless otherwise stated.

Online Payment
Our App includes online payments for some products, so you have to use the payment methods authorized on our website like for example but not limited to Visa & Master card, and any other UAE authorized payment services that are integrated with our platform and Payment Gateway provider. If you use your own pay service, then it’s on your own responsibility and your own agreement with that provider and subject to your provider’s terms and conditions, by which The Voucher App has no responsibility in whatsoever.
Our App accepts online payments using Visa & Mastercard credit/debit in AED and USD currencies.
The cardholder must retain a copy of transaction records and The Voucher App company's policies and rules.
Governing Law & Jurisdiction
All disputes, legal suit, or any action arising out, or related to these Terms of Use, App, or Website shall be governed by Dubai Courts in UAE.
Time Limitation to File Claims
All claims, disputes, legal suit, or any action arising out, or related to these Terms of Use, App, or Website shall must be commenced within one year from the date of action otherwise such claim or action is prohibited and not valid anymore.
Indemnification
You agree to defend, indemnify and hold harmless The Voucher App, its affiliates and their respective directors, officers, employees and agents ("Affiliated Parties") from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorney’s fees and costs) arising out of or accruing from:
(a) any misrepresentation made by You in connection with Your use of The Voucher App; (b) any non-compliance by You with the terms and conditions of this Agreement; and (c) claims regarding any liability, loss, claim and/or expense arising from or related to Your access and use of The Voucher App.
Changes to this Terms & Conditions
We reserve the right to change the Terms of Use at any time. Any such changes we may make to this Terms & Conditions will be posted on the App (The Voucher App), and website, and maybe emailed to you. Please check the Terms & Conditions available on The Voucher App and website from time to time. In the event of any such change, by continuing to use The Voucher App and website you agree to the relevant change. Modifications will be effective on the day they are posted.
